Terms and conditions
Effective November 2026
These terms cover your use of this website and our services. Ruby64 is a service of Wenley Technologies LLC (“we,” “us”). Each project also has its own written proposal or agreement (your “scope”). If anything in your scope differs from these terms, your scope wins.
1. Using this website
You’re welcome to browse this site and contact us. The content, design, and portfolio images are ours or our clients’ and are shown with permission. Please don’t copy or reuse them without asking. Links to outside sites are for convenience; we aren’t responsible for their content.
2. Proposals and starting work
Every project gets a written scope and a fixed price before work begins. Quotes are valid for 30 days. A project starts once you accept the scope in writing (email is fine) and the first payment is received.
3. Payment
Unless your scope says otherwise, payment is 50% to start and 50% at delivery. Invoices are due within 14 days. If a payment is late, we may pause work, and overdue balances may be charged a late fee of 1.5% per month, or the highest rate allowed by law if that is lower. Final files and logins are handed over once the project is paid in full.
Third-party costs, such as domain names, hosting plans, stock images, fonts, or paid tools, are paid by you and are not included in our fees unless your scope says so.
4. Your responsibilities
You agree to provide the content, photos, account access, and feedback we need, and to name one person who can approve work. You’re responsible for making sure everything you give us is accurate and that you have the right to use it. If we don’t hear from you for 30 days, we may pause the project, and restarting it may need to be rescheduled.
5. Revisions and changes
Your scope lists the rounds of revisions included. Changes beyond those rounds, or work outside the agreed scope, are quoted separately and only done with your written approval.
6. Your approval
Nothing goes live or gets published until you approve it. Once you approve a deliverable, it is considered accepted.
7. Ownership
Once you’ve paid in full, you own the final website content, graphics, and written pieces we create for you. Items made by others, such as fonts, stock photos, plugins, and templates, stay under their own licenses, which we’ll pass along to you. Our working files, tools, and general methods remain ours unless your scope includes them.
8. Portfolio
We may show the finished work in our portfolio and marketing. If you’d rather we didn’t, tell us in writing and we’ll respect that.
9. Confidentiality
We keep private any non-public information you share with us during a project, such as logins, plans, and finances, and we expect the same of you regarding our pricing and working materials. This continues after the project ends.
10. Features and press
Feature Stories published on HerNewswire are clearly labeled as Sponsored Features. When we pitch your story to other outlets, we can’t guarantee they will publish it, and coverage elsewhere is never purchased.
11. After launch
Launch packages include two weeks of touch-ups for small fixes after delivery. After handover, hosting, security updates, backups, ongoing posting, ads, and new features are your responsibility unless we agree in writing to provide them.
12. Cancellation and termination
Either of us may end a project with written notice. If you end it, the first payment is non-refundable and covers work already done; any completed work beyond that is billed. If we end it for reasons other than non-payment, we’ll deliver the work completed so far and refund any amount paid for work not yet done.
13. No guarantees
We do our work with care and skill, but we can’t guarantee specific results such as search rankings, traffic, follower counts, sales, press coverage, or election outcomes. Work is provided as approved by you, without other warranties.
14. Limitation of liability
Our total responsibility for any project is limited to the amount you paid us for that project. We aren’t responsible for indirect losses, such as lost profits, lost data, or business interruption.
15. Indemnification
You agree to cover any claims, costs, or damages that arise from content or materials you provide to us, or from how you use the finished work.
16. Events beyond our control
Neither of us is responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, illness, outages at hosting or social media platforms, or government action.
17. Disputes and governing law
If a disagreement comes up, we’ll first try to resolve it in good faith by talking it through. These terms are governed by the laws of the District of Columbia.
18. Changes to these terms
We may update these terms. The version posted here, with its effective date, applies to new projects. Projects already underway follow the terms in place when the scope was signed.
